VELUX conservation rooflights and planning. What it means in practice on Essex housing stock, and how we approach it.

A VELUX conservation rooflight is not a different window. It is a standard VELUX roof window dressed and fitted so it reads like the cast-iron rooflight that would have sat in a Victorian slate roof: low in the plane, black on the outside, split down the middle by a glazing bar. That last part matters because it is often the difference between an approval and a refusal, and in the Leigh conservation areas it is the difference between a job that needs planning consent and one that never gets built. This page explains what the product is, when the planning rules bite, and what a conservation officer is actually looking at when they open your application.
What makes a VELUX rooflight a conservation model
The confusion worth clearing up first: there is no separate window in the catalogue called a conservation window. What you are buying is an ordinary centre-pivot or top-hung VELUX, the same GGL or GGU sash that goes into any loft, combined with three things that change how it looks from the street.
The first is a black external finish rather than the usual grey aluminium. Traditional rooflights were cast iron, and cast iron reads as near-black once it has weathered, so a matt black sash cover and flashing sit quietly in an old roof where a silver frame would jump out.
The second is the recessed flashing kit. A standard VELUX sits proud of the tiles or slates on its own upstand. A conservation installation uses a recessed flashing so the sash drops roughly 40mm deeper into the roof, bringing the glass much closer to the plane of the surrounding covering. From the pavement the window looks set into the roof rather than bolted on top of it.
The third is the vertical glazing bar. A single bar runs top to bottom across the pane, splitting one large sheet of glass into two tall lights. Genuine period rooflights had multiple small panes held in a metal frame, and the bar is a nod to that proportion. Conservation officers ask for it by name, and a window without it will often be the reason a case gets sent back.
Put those three together and you have what the trade shorthand calls a conservation rooflight. The glass, the opening mechanism and the guarantee are the same as any other VELUX. Only the appearance and the depth of the fit have changed.
When you actually need planning permission
On an ordinary house outside any designation, most rooflights are permitted development. That means no planning application, provided the window meets the conditions the law sets. The main ones are worth stating plainly, because people assume they need consent when they do not, and occasionally the reverse.
- The rooflight must not project more than 150mm above the plane of the existing roof slope. A recessed conservation fit clears this easily; it is a flush-mounted window sitting high on its upstand that gets people into trouble.
- No part of the window may sit higher than the highest part of the existing roof, so nothing above the ridge.
- On a side elevation roof slope, any opening below 1.7m from the floor of the room needs obscure glazing and restricted opening, which is a privacy rule rather than an appearance one.
Meet those and a rooflight on a standard house needs no planning permission at all. The whole point of the conservation range only comes into play when the permitted-development route is closed, and there are four situations where it is.
Flats and maisonettes never had the permitted-development rights that houses do, so a rooflight in a converted flat needs an application whatever it looks like. Listed buildings need listed building consent, which is a separate and stricter process covered further down. Conservation areas restrict what can go on a roof slope facing a road. And an Article 4 Direction removes permitted-development rights that would otherwise apply, which is exactly the situation across parts of Leigh.
The Leigh Article 4 Direction and why it changes the answer
This is where south Essex stops being a footnote. The Leigh Cliff and Leigh conservation areas both carry an Article 4 Direction that removes permitted-development rights for changes to roofing materials and windows. The conservation area appraisals for both were updated in March 2022. In practice this means that a rooflight which would be permitted development on a house half a mile away needs a full planning application here, even where it meets every one of the 150mm and below-the-ridge conditions above.
An Article 4 Direction does not ban the work. It removes the automatic right, so the council gets to look at each case and decide. This is precisely the situation the VELUX conservation range was built for. A recessed black window with a glazing bar gives the case officer something they can approve without a fight, because it does the one thing they are charged with protecting: it keeps the roofscape looking as it did.
Leigh is not the only designation in the patch. Clifftown, the Victorian planned estate near the seafront, and Leigh Old Town, the tight run of former fishing cottages with a core that runs from the thirteenth to the eighteenth century, are both conservation areas as well. The railway reached Leigh in 1856 and development spread east along the cliff top, which is why you get such a consistent band of Victorian and Edwardian roofs across that stretch. Consistency is exactly what a conservation area exists to keep, so a modern silver rooflight breaking a run of slate is the kind of thing an officer will resist and a neighbour will notice.
If your property sits inside any of these, the first move is to check with Southend-on-Sea City Council before ordering anything. A phone call to the planning duty desk with your address will tell you which designation applies and whether an Article 4 Direction is in force on your particular slope.
What a conservation officer is looking for
An officer assessing a rooflight in a conservation area is weighing one question: does this preserve or enhance the character of the area. That sounds vague until you know the specific things they check, which are consistent enough to list.
- Is it recessed? A window that sits flush or near-flush with the slate is far more likely to pass than one perched on a visible upstand. The recessed conservation flashing is doing real work here.
- Is the finish dark? Black or near-black external frames disappear into an old roof. Grey aluminium does not.
- Is there a glazing bar? The vertical bar breaks the pane into a proportion that reads as traditional. Its absence is one of the more common reasons for a refusal or a request to amend.
- Where is it on the roof? Rooflights on the rear slope, away from the public street, are almost always easier than ones on the front elevation facing a road. Officers will often accept a rear rooflight and resist a front one on the same house.
- How big, and how many? A single modest window in proportion to the roof is a different case from three large ones. Keeping the glazed area sensible relative to the slope helps.
None of this is a guarantee, because each conservation area has its own appraisal and each officer applies judgement. But a recessed black conservation model with a glazing bar on a rear slope is close to the easiest case you can present, and it is why the range exists at all.

Sizes, pitches and the specification numbers
VELUX windows are ordered by size code, not by loose dimensions, and the conservation kit is available across the common sizes. The pitch of your roof also matters: the centre-pivot models fit roofs from about 15 to 90 degrees, and the conservation flashings are rated for tiled or slate roofs within the usual pitch bands. Most Victorian and Edwardian slate roofs across Leigh and Clifftown sit somewhere between 30 and 45 degrees, which is comfortably inside range.

The glass is where the numbers earn their keep. A modern VELUX double-glazed conservation unit runs a U-value around 1.2 to 1.0 W/m²K, which clears the Part L limit for a replacement rooflight without difficulty. That is the winter number. The summer number, the G-value, is the one that tends to be left off the conversation, and on a south-facing slope it is the one you will feel most. Standard double glazing lets through something like 60 per cent of the sun’s energy. A solar-control unit brings that down toward 30 per cent while keeping the room bright. Listed buildings are a separate and stricter matter
A conservation area protects the look of a neighbourhood. A listing protects an individual building, inside and out, and the bar is higher. If your house is listed, you need listed building consent for a new rooflight, and this is a genuinely separate application from ordinary planning permission. Carrying out work to a listed building without consent is a criminal offence, so this is not a corner to cut.
On a listed roof, an officer may want the rooflight kept off any principal elevation entirely, may specify a particular size or position, and will often ask for a conservation-pattern window as the minimum acceptable standard rather than as a helpful gesture. Some of the most sensitive roofs take a metal-framed heritage rooflight rather than a VELUX at all, and where a roof is that important we would talk you through a bespoke conservation-pattern rooflight instead. The point is that a listing changes the whole approach, and the first step is always to establish whether the building is listed and at what grade before any product is chosen.
One thing worth being clear about: this page is about installation and replacement of rooflights, not remedial work to a failed roof. If your existing rooflight is leaking and the roof structure around it is the problem, a roofer is the right first call. Where the unit itself has failed and needs swapping for a new one, that is a replacement, and a conservation-area replacement is a job we handle in the normal way, notification and all.
Building Regulations still apply, designation or not
Planning permission and Building Regulations are two different systems, and clearing one does not clear the other. A new or enlarged rooflight is notifiable under Building Regulations whether or not you are in a conservation area. Two parts of the regulations are in play.
Part L covers thermal performance and sets the maximum U-value a new or replacement rooflight in a dwelling is allowed. Any conservation VELUX worth fitting beats that limit. Part K covers safety glazing and guarding, and because a rooflight is overhead glazing, the inner pane needs to be laminated so that it holds together if it ever breaks. These are not optional extras; they are the baseline the installation has to meet on paper.
Every installation we carry out is notified to Building Control. We make that notification to Southend-on-Sea City Council, or to the relevant local authority for your address, on your behalf as part of the job, so you are not left chasing a certificate afterwards. That notification is separate from any planning consent the conservation designation requires, and you may need both. Aspect still matters, even in a conservation area
Here is the part that conservation guidance never mentions and that Southend makes unavoidable. The city faces south across the Thames Estuary, which is unusual for an English seaside settlement and means the rear slopes of a great many Leigh and Clifftown roofs point somewhere between south-east and south-west. Those are the slopes an officer most wants a rooflight kept to, because they are away from the street. They are also the slopes that collect the most sun.
A rooflight faces closer to straight up than a wall window, so a slope catching the estuary sun gathers a lot of solar energy through the middle of the day, and the estuary itself throws reflected light back up onto every south-facing plane along that coast. A conservation window solves the planning problem. It does nothing about the heat, because the black finish and the glazing bar have no bearing on what the glass lets through. If your conservation rooflight is going into a south-facing rear slope, the glass specification is a decision in its own right, and it is worth asking for a solar-control glazing option so the room does not overheat in July. The same VELUX size code and the same conservation kit can carry different glass, and matching the G-value to the aspect is where a good specification is made.
North-facing slopes are the opposite case. There is no direct sun to control, so clear glass and all the daylight you can get is the right call, and you can save the solar-control coating for the plane that needs it. On a pitched slate roof with rooflights front and rear, the two windows may look identical from the street and carry quite different glass behind the same black frame.
How to get a conservation rooflight approved and fitted
The order of operations saves time and avoids buying the wrong thing. Establish the designation first: ring the council with your address and find out whether you are in a conservation area, whether an Article 4 Direction applies, and whether the building is listed. If you are in a designated area, plan for a planning application, and if the building is listed, plan for listed building consent as well.
Specify a recessed conservation model in a black finish with the central glazing bar, and keep it to the rear slope and to a sensible size wherever the room allows. Support the application with drawings that show the recessed depth and the position on the roof, because that is what the officer is assessing. Choose the glass to suit the aspect at the same time, not as an afterthought once the window is on order.
